This essay highlight limits of contitutional reform reducing parlamentary members. At first sight this appear like an easy and bounded reform: but really it is not, the devaluation of political representation is at stake, one of the highest values of any constitutional system. To conclude, politics seems to lose value and it is important to avoid a devaluation of political representation too.
Constitutive Rules: The Symbolization Account

Our aim is to provide an account of constitutive rules in terms of (1) the acceptance of regulative norms, and (2) a cognitive process we call “symbolization” (in an altogether different sense from what J. R. Searle means by this word). We claim, first, that institutional facts à la Searle boil down to facts concerning the collective acceptance of regulative norms in a given community. This, however, does not exhaust what institutional facts are. There is a residue, symbolization. Symbolization, as we understand it, involves a transfer of cognitive models from one domain to another. Rethinking Political Representation from the Perspective of Rhetorical Genres

This article is a thought experiment. It constructs ideal types of political representation in the sense of Max Weber. Inspired by Quentin Skinner and others, the aim is to give a rhetorical turn to contemporary debates on representation. The core idea is to claim an ‘elective affinity’ (Wahlverwandschaft, as Weber says following Goethe) between forms of representation and rhetorical genres of their justification. The four ideal types of political representation are designated as plebiscitary, diplomatic, advocatory, and parliamentary, corresponding to the epideictic, negotiating, forensic, and deliberative genres of rhetoric as the respective ways to plausibly appeal to the audience. In the judgment no. 62 of 2022, the Italian Constitutional Court deals one more time with the principle of equal access in political representation. The decision shows a new approach of the Italian Constitutional Judge in strengthening gender equality, on the basis of Art. 3rd and Art. 51.1st of the Italian Constitution and provides the principle with a new effectiveness.

This essay highlight limits of contitutional reform reducing parlamentary members. At first sight this appear like an easy and bounded reform: but really it is not, the devaluation of political representation is at stake, one of the highest values of any constitutional system. Particular attention should be given to two negative consequences in case of success: the weakening of the Parliament aggregate function, the submission of its members to more stringent party constraints and and finally, the tightening of relations within parties.
